Judge Change Hits Steven Tyler Accuser’s Lawsuit Less Than Two Weeks Before Trial

By Website Content Manager

The lawsuit is being transferred to a different judge, and the attorneys are scheduled to meet with a supervising judge on Sept. 18.

A Los Angeles judge has stepped aside from the lawsuit involving Steven Tyler, with the change coming less than two weeks before the case is scheduled to head to trial.

Judge Patricia A. Young told attorneys during a status conference on Monday, Sept. 15, that she had determined she was disqualified from continuing to preside over the case, according to court documents obtained by PEOPLE.

The court informed the parties of the issue the previous day and gave the attorneys 24 hours to decide whether they would consent to Young remaining on the case. The filing states that the parties did not all agree.

“The Court hereby recuses itself on this case,” the court document states.

The matter will now be assigned to another judge. Attorneys have been directed to appear before Supervising Judge Lawrence Riff at the Stanley Mosk Courthouse in Los Angeles on Friday, Sept. 18. The hearing will address the reassignment and determine whether the case remains on track for trial.

According to the filing, jury selection and trial proceedings are currently scheduled to begin Sept. 28, with the trial expected to run for approximately seven to 10 days.

The lawsuit was brought in December 2022 by Julia Misley, who alleges that Tyler sexually assaulted and sexually battered her and caused intentional emotional distress during an alleged relationship when she was a teenager in the 1970s.

Several of Misley’s claims were dismissed earlier this year. However, a Los Angeles judge ruled in April that one claim alleging intentional infliction of emotional distress could continue, according to court records previously obtained by PEOPLE.

That remaining claim involves an allegation concerning sexual activity between Misley and Tyler at a hotel and in a public hot tub in California in 1974, when Misley says she was 16.

Tyler has faced allegations related to Misley’s claims, but the remaining matter is still a civil lawsuit and the allegations have not been established as facts by a court.
